Terms of use

1. General

Welcome to the Minko Atelier & A.Indigo Art online store. These terms and conditions apply to orders and purchases made through our online store. By placing an order, the customer agrees to the terms and conditions applicable to that order. Our online store offers original artworks, art prints, and custom commissioned works.

2. Products and Product Images

The products sold include original artworks, art prints, and other art-related items featured in the online store. We strive to represent our products as accurately as possible; however, the appearance of colors may vary depending on the settings of individual screens and devices. Original artworks are unique, and natural variations inherent to the artist's creative process may occur. Product dimensions, materials, and other essential specifications are provided in the product descriptions.

3. Prices and Payment

All prices in the online store are listed in euros. Information regarding value-added tax (VAT) is provided alongside the product price, in accordance with applicable legislation. Shipping costs are disclosed to the customer prior to order confirmation. Payments may be made using the methods available in the online store. Payment service providers may impose their own specific terms and conditions. The customer is responsible for ensuring that all information provided when placing an order is accurate.

4. Ordering and Order Confirmation

Customers may place an order in the online store by selecting the desired products and completing the ordering process. Once an order has been received by our system, an order confirmation will be sent to the customer via email. We will contact the customer if there are any ambiguities regarding the order or issues with product availability.

5. Deliveries

We deliver products to the delivery areas specified in the online store. Delivery options, shipping costs, and estimated delivery times are provided during the ordering process. We aim to dispatch orders within the stated delivery timeframe. Customers will be notified of any significant delays. It is the customer's responsibility to provide accurate and sufficient delivery information.

6. Returns and Right of Cancellation

In distance selling, consumer customers generally have the right to cancel their purchase within 14 days of receiving the products, in accordance with the Consumer Protection Act. To exercise this right, the customer must provide the seller with an unequivocal notification of cancellation within the specified period. Products must be returned in accordance with the provided instructions. The customer is responsible for the direct costs of returning the items, provided that this has been clearly communicated to the customer prior to placing the order. The right of cancellation is subject to the exceptions stipulated by law. For example, products that are genuinely manufactured according to a customer's specific personal requirements, or that are clearly personalized, may not be subject to a right of withdrawal. This could apply, for instance, to a pet portrait painted individually based on a photograph provided by the customer. This exception does not automatically apply to all works of art or art prints. Due care must be exercised when handling a product that is to be returned. In accordance with the law, the customer may be held liable for any decrease in the value of the product if it has been handled more than is necessary to establish its nature, characteristics, and functioning. Detailed return instructions and contact information are available in our online store.

7. Defective and Damaged Products

If a product is defective, damaged, or does not correspond to what was agreed upon, we ask the customer to contact us as soon as possible. We handle complaints in accordance with applicable consumer protection legislation. Statutory rights regarding product defects remain in effect, regardless of any voluntary return policy we may offer.

8. Commissioned Works and Pet Portraits

Details regarding commissioned artworks—such as size, execution method, price, and estimated delivery time—are agreed upon at the time the order is placed, based on the customer's wishes. The customer must ensure that they have the right to provide us with the photographs and any other materials used. The right to cancel a commissioned work is determined by the unique nature of the product and applicable legislation. Any specific terms and conditions will be communicated to the customer before the order is confirmed.

9. Copyright

Artworks, images, texts, and other content in the online store are protected by copyright or other applicable rights. Purchasing a product does not transfer the copyright of the work to the customer. The customer acquires the product for personal use, unless otherwise agreed in writing. Copying, commercial use, distribution, or any other use of the works that infringes upon copyright without the permission of the rights holder is prohibited.

10. Processing of Personal Data

We process customers' personal data for the purposes of order processing, payment, delivery, customer service, and compliance with legal obligations. Further details regarding the processing of personal data can be found in the online store's privacy policy.

11. Applicable Law and Dispute Resolution

Finnish law applies to the online store and orders placed through it, unless otherwise required by mandatory legislation. Any disputes shall primarily be resolved through negotiations with the customer. In accordance with applicable legislation, a consumer may refer the matter to a competent authority for consumer dispute resolution or to a court of law.
